These Terms of Use (“Terms”) govern your access to and use of the PepTrack mobile application, website, and related services collectively referred to as the “Service.”

1. Eligibility

2. PepTrack Is Not Medical Advice

PepTrack is a personal tracking, organizational, and educational tool. It is not a healthcare provider, pharmacy, medical device, or substitute for professional medical advice.

PepTrack does not diagnose, treat, cure, prevent, or monitor any disease or medical condition. Information provided through the Service should not be interpreted as medical advice, a prescription, a treatment recommendation, or confirmation that any peptide or protocol is safe, legal, effective, or appropriate for you.

Always consult a qualified healthcare professional before beginning, stopping, or modifying any peptide, medication, supplement, dosage, or health-related protocol.

Never disregard professional medical advice or delay seeking medical care because of information displayed through PepTrack. If you believe you are experiencing a medical emergency, contact emergency services immediately.

3. Your Responsibility

You are solely responsible for:

• Verifying the accuracy of information you enter into PepTrack.

• Following instructions provided by your licensed healthcare professional.

• Confirming dosages, schedules, measurements, and protocol details before acting on them.

• Using legally obtained products in accordance with applicable laws.

• Seeking medical guidance regarding side effects, interactions, symptoms, or health concerns.

• Keeping your device and account credentials secure.

Reminders, calculations, summaries, notifications, and other information displayed by PepTrack may contain errors, experience delays, or fail to appear. You should not rely on PepTrack as your only record or reminder for any medically important action.

4. Accounts

Certain features may require an account. You agree to provide accurate information and keep it updated.

You are responsible for all activity conducted through your account. You must notify us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate accounts that violate these Terms, create security risks, or misuse the Service.

5. License to Use PepTrack

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use PepTrack for lawful, personal, noncommercial purposes.

You may not:

• Copy, modify, distribute, sell, sublicense, or commercially exploit the Service.

• Reverse engineer, decompile, or attempt to extract PepTrack’s source code, except where applicable law expressly permits it.

• Interfere with the operation or security of the Service.

• Access the Service through unauthorized automated methods.

• Attempt to gain unauthorized access to another user’s account or data.

• Use PepTrack to violate any law or the rights of another person.

• Upload malicious code or content.

• Misrepresent PepTrack as providing medical care or professional medical recommendations.

6. User Content

You may enter notes, schedules, measurements, photos, protocol information, and other content into PepTrack (“User Content”).

You retain ownership of your User Content. You grant us a limited license to host, process, store, reproduce, and display that content only as reasonably necessary to operate, maintain, secure, and improve the Service.

You represent that you have the right to submit your User Content and that it does not violate any law or third-party rights.

Our handling of personal information is described in the PepTrack Privacy Policy.

7. Subscriptions and Payments

PepTrack may offer free and paid features. Paid features may be provided through an automatically renewing subscription.

Before purchasing, you will be shown the subscription price, billing period, included features, and any available trial terms. Prices may vary by country or region.

When purchased through Apple:

• Payment is charged to your Apple Account.

• Your subscription renews automatically unless canceled before the end of the current billing period.

• You can manage or cancel your subscription through your Apple Account settings.

• Billing, cancellations, and refunds are generally administered by Apple under its applicable terms.

• Deleting PepTrack does not automatically cancel an active subscription.

If a free trial is offered, it will convert to a paid subscription unless canceled before the trial ends. Any unused portion of a free trial may be forfeited when a paid subscription begins, where permitted by law.

We may modify subscription prices or features with the notice required by applicable law and the relevant app marketplace.

8. Intellectual Property

PepTrack and its software, design, branding, graphics, text, functionality, and other content—excluding User Content—are owned by us or our licensors and are protected by intellectual-property laws.

“PepTrack” and associated names, logos, and branding may not be used without our prior written permission.

9. Third-Party Services

PepTrack may integrate with or link to third-party services, including Apple services, authentication providers, cloud infrastructure, subscription platforms, or health-data platforms.

We do not control these services and are not responsible for their availability, accuracy, security, content, or practices. Your use of a third-party service may be governed by separate terms and privacy policies.

10. Apple Health

If PepTrack offers an Apple Health integration, access is optional and requires your permission. You control which supported data types PepTrack may read or write through your device settings.

PepTrack will not use Apple Health information for advertising or sell it to data brokers. Apple Health information should not be treated as a substitute for records maintained by your healthcare provider.

11. Service Availability and Changes

We may add, modify, suspend, or discontinue any part of PepTrack at any time. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

Features may vary by device, operating system, subscription level, location, or applicable law.

When reasonably possible, we will provide notice before discontinuing a material feature, but we are not obligated to maintain any particular feature indefinitely.

12. Disclaimer of Warranties

To the maximum extent permitted by law, PepTrack is provided “as is” and “as available.”

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and results arising from use of the Service.

We do not warrant that:

• PepTrack will meet your individual health or tracking needs.

• Information, calculations, reminders, or notifications will be complete or accurate.

• The Service will operate without interruptions or errors.

• Using PepTrack will produce any health, wellness, or medical outcome.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by law, PepTrack and its owners, officers, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of—or inability to use—the Service.

This includes loss or harm resulting from:

• Reliance on reminders, calculations, schedules, or other app information.

• Incorrectly entered or displayed information.

• Missed notifications or service interruptions.

• Decisions involving peptides, medications, supplements, or healthcare.

• Unauthorized access to your account or information.

• Loss of data, revenue, profits, or business opportunities.

To the maximum extent permitted by law, our total liability for claims relating to the Service will not exceed the greater of:

• The amount you paid to use PepTrack during the 12 months preceding the claim; or

• 25 U.S. dollars.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PepTrack and its owners, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, and expenses arising from:

• Your misuse of the Service.

• Your violation of these Terms.

• Your violation of applicable law or another person’s rights.

• User Content you submit through PepTrack.

15. Termination

You may stop using PepTrack at any time. You may request account deletion using the available in-app controls or by contacting us.

We may suspend or terminate your access if you materially violate these Terms, misuse the Service, create a security or legal risk, or fail to pay applicable fees.

Termination does not automatically cancel subscriptions administered by Apple. You must cancel those subscriptions through your Apple Account settings.

Provisions that logically should survive termination—including intellectual-property, warranty, liability, indemnification, and dispute provisions—will remain effective.

16. Governing Law and Disputes

These Terms are governed by the laws of [State and country], without regard to conflict-of-law principles.

Any dispute that is not resolved informally will be brought in the state or federal courts located in [County, state], and you consent to their jurisdiction, unless applicable consumer law gives you the right to bring a claim elsewhere.

17. Apple-Specific Terms

If you download PepTrack through Apple’s App Store, you acknowledge that:

• These Terms are between you and PepTrack, not Apple.

• PepTrack, rather than Apple, is responsible for the Service and its content.

• Apple has no obligation to provide maintenance or support for PepTrack.

• Apple is not responsible for addressing claims relating to PepTrack or your use of it.

• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.

• Your use of PepTrack must comply with the App Store’s applicable usage rules.

Where Apple’s Standard Licensed Application End User License Agreement applies, it is incorporated into these Terms.

18. Changes to These Terms

We may update these Terms as PepTrack evolves. We will update the effective date and provide additional notice when required.

By continuing to use the Service after revised Terms become effective, you agree to the revised Terms. If you do not agree to an update, you must stop using PepTrack.

19. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your rights under these Terms without our consent. We may transfer our rights and obligations as part of a merger, acquisition, restructuring, or sale of assets.

These Terms and the Privacy Policy constitute the entire agreement between you and PepTrack regarding the Service.
